Why Delhi HC refers CJP protest plea to CJ bench?

New Delhi: In a major blow to opponents of the Cockroach Janta Party protesters, Delhi High Court on Friday refused to hear a petition seeking criminal action and compensation against those who damaged public property during the protest at Jantar Mantar.

The court allowed the petitioner to approach the concerned authority. The PIL was filed by Save India Foundation (SIF).

The court directed the concerned authority to consider the representation and take an appropriate decision in accordance with the law.

The Delhi High Court referred it to the Chief Justice-led Division Bench which is hearing the similar matter in the Supreme court.

"Is this a PIL? Why not? You should file it as a PIL when you don't have a personal locus. I have read your petition," the Court observed.

"I do not see how a Single Bench can hear a matter of this nature, which is in the nature of a PIL," the Court remarked, adding, "The Court will proceed according to law."

The plea filed by SIF, a reportedly new member of the Hindu Right ecosystem, said that the CJP protesters on July 24 created a lawlessness in national capital and no effective action has been taken.

SIF alleged, further, protesters assaulted police personnel and damaged public property. They created a panic around Parliament, causing inconvenience to the public.

The organisation added in its petition that despite the evidences such as news reports, CCTV footage and social media videos, the Delhi police has not taken action.

Going further, the Supreme Court has agreed to hear a petition regarding police action against students protesting at Jantar Mantar.

Senior Advocate Gopal Shankaranarayanan mentioned the matter before the court, stating that a petition has been filed and the diary number has been generated.

He said the situation is serious and urgent, and students are facing police excesses. Chief Justice of India Surya Kant assured that the hearing could be scheduled on Monday.
